a settlement could be announced in the case of a dog ordered to be euthanized after it bit a police dog. city officials say the dog is vicious and should be put down. monte francis is live at christie field this morning with a look at the details for us. good morning, monty. >> reporter: good morning. this is where the dog attacked a police horse back in august. the dog's name is charlie. the story sparked very strong feelings on both sides. charlie is an american stafford terrier and in august he attacked a police horse. u.s. park police say charlie chased the horse for more than a mile and bit the horse several times. an officer was thrown from the horse and knocked unconscious. charlie's owner was charged with not having control over his dog and police say the dog is vicious and should be put down. since the attack charlie has been in the custody of animal control. the city attorney actually

offered a deal to send charlie to an animal sanctuary instead of being put down but his owner refused. more than 100,000 people have signed an online petition asking the city to spare charlie's life and owner since filed a lawsuit against the city claiming that his civil rights have been violated. >> the issue is very controversial. everyone just wants it to end. me included. i'm doing my best to hopefully come up with a fair and reasonable settlement and hopefully the city will agree. >> reporter: the attack left the horse with injuries requiring stitches and police say the dog owner had no control. we're told there could be resolution in the case later today. in the meantime the case goes before a federal judge on friday and that judge could decide to toss out the police department's findings. live in san francisco, monte francis, "today in the bay." east bay hayward mom is

speaking out after learning a bone fragment found near stockton does not match her daughter who was kidnapped in 1998. the mother wrote in a blog post yesterday, "there is a degree of disappointment that answer has alluded us once again" and frustration of never having the answers. the overriding feeling i experienced was a sense of relief. investigators thought they found a bone thought to be the dumping grounds of the speed freak killers but testing revealed the bone belongs to a victim identified months ago. san francisco police are hoping surveillance video will help catch a suspected killer. police say this video shows a clean shaven man with long hair walking with 46 year old cruz back in october. that man was seen entering

cruz's apartment on eddie street in the city's tenderloin. later that night officers responded to a report of a disturbance at that apartment and found cruz stabbed to death. as of now investigators say there's no motive for the killing. anyone with information regarding the suspect is asked to call police. 5:04. was faulty radar to blame for monday's oil tanker crash on the bay bridge? the nbc bay area investigative unit obtained documents indicating at least one tower was not working when the ship hit the bridge. signal is sent indicating where the center of the bridge is. >> if it is not working, i have lost a very important aid to me and i have to find other substitutes for that.

>> caltrans is responsible for the navigation equipment on the bay bridge. the attorney for guy kleess issued a statement saying many factors could contribute to the accident. there are causes for investigators to study such as mechanical fa aal failure, unpredictable fog conditions and actions of the ship's bridge crew. a cold snap across the bay area today. that's why we sent meteorologist christina loren out in the thick or thin of it. thin air this morning. up in san francisco. good morning. >> good morning to you, laura and marla. good morning to you at home. i'm out here live in san francisco. i have never been out to twin peaks. i want to give you a view of just how lovely it is at 900 feet looking down at this city. i'm at about 900 feet. it always goes up to about 977 feet if you get to the highest peaks here in san francisco. what i can tell you is we still

have rain on the radar. we're getting into the coldest point of the day and if you take a look at the santa cruz mountains, you can see a mix of rain and snow coming down and as we progress throughout the next three hours getting closer to sunrise, the coldest point of the day, our chance for some low snow levels will improve which is why i'm out here waiting, hoping, praying, for a dusting of the white stuff. we'll see what happens. the chance is very thin. nonetheless we're out here tracking it for you. temperatures are cold right now as i said before they'll continue to drop off as we head throughout the morning. the moisture supply gets cut off as we head through 9:00 a.m. the showers will thin out completely. our window really resides between now and 9:00 a.m. for getting any sort of flurry action right here in san francisco. what i can tell you as you make your way out the front door headed to work this morning and throughout the interior valleys, you want to travel cautiously because it's cold enough for the formation of black ice. we're not expecting a lot of the snow to stick in elevations below 1,000 feet.

if he would keep the kings name. the seattle supersonics recently moved to oklahoma city, the basketball team. that's the first team we're seen a microsoft team, seattle seahawks owned by microsoft founder paul allen. let's check in with cnbc. courtney reagan is live at cnbc world headquarters. good morning, courtney. >> good morning to you, scott. futures are higher after stocks snapped a mini losing streak yesterday. traders may focus today on an interest rate decision by the european central bank and several speeches by federal reserve officials about the u.s. economy. we'll get data a little bit later on unemployment and trade. the dow rising 61 points on wednesday to 13,390. the nasdaq adding 14 points to open at 3105. scott, back to you. >> thank you much. we expect president obama will nominate his chief of staff jack lew to run the u.s. treasury this morning. not a terribly controversial choice. there is some concern though

good morning to you marla and everyone at home. an exciting day for meteorologists in the bay area. when we get snow on top of mt. hamilton, that's a big deal. today we could accumulate maybe two inches of snow high atop mt. hamilton. here at twin peaks, the possibility for some snow flurries is actually at about 20% to 30% this morning. it will get better as we progress throughout the next two to three hours. right now take a live look at your radar. beautiful looking radar picture there. you see all that pink. those little flashes of pink are a mixture of rain and snow right now down to about 2,500 feet. as we head into the next hour, we'll see the snow level drop potentially to 2,000 feet and between 6:00 and 8:00, coldest time of the day, we're talking about snow level down to 1,000 feet. it just really is dependent on where the areas of precipitation develop and where they move over. if we see any rain move over higher elevations, it will come down in the form of snow.

windchill factor is taking place out here this morning. it's breezy. so that's making your true temperatures already cold in the 30s feel more like the upper 20s in some cities. you want to keep that in mind and winds will pick up throughout the morning hours. now, the good news is if you don't want the rain, if you are sick of it, we're going to get rid of that chance as of about 9:00 a.m. this morning. bone dry at that point. that's really where we'll cut off the opportunity for getting low level snow between now and 9:00 a.m. is our time frame. so highs today will be cold. you'll need the heavy coat all day long. a good day to break out the scarf, the mittens, everything you have to stay warm and especially bundle up the little ones. we'll get your seven-day outlook. we have a big weekend just around the corner now. today will be cold. tomorrow looking at some pretty thick frost to wake up to. 50 degrees. that's all we're expecting as daytime high inland. as we get into the weekend, it will be cold and maybe a stray shower on sunday but looking

okay. lots of sunshine on the way for next week. temperatures will stay cool starting to warm up a little bit wednesday into thursday. back into the 60s. back out here live, a beautiful clear start overlooking san francisco this morning. it's just crystal clear out here. it's so cold and i can certainly tell you firsthand you'll need that heavy winter coat. mike, i was driving in and i certainly noticed a lot of company on 101 this morning. a lot of construction as well. >> most of that cleared up by 5:00 in the commute direction. you did join the morning commute later than we typically do. thank you for being out there making that tougher drive. we're looking at 101 with a good amount of company even along the peninsula. this is thursday. we'll see heavier flow than yesterday. 101 not a concern. i'll show you maps in the same why where we do have issue here. it's 101, 280 and pink and green. damp conditions for roadways and possibly some ice through this area as well as 92 reported earlier watch patches as well

over in half moon bay. reports of a car fire on the east bay as well. west 580 as you head over toward five canyons that's much more recognizable off-ramp. we see slowing in the area. chopper headed to the scene. reports of a car engulfed. i'll track that. i see slowing kicking in possibly an issue for drivers through that area. that's castro valley in your commute direction. we'll see how things shape up over the san mateo bridge. nice easy drive in the westbound direction. no real problems. wind might catch you with a gust or two but not a big concern here. another live look shows how things are shaping up at the bay bridge. chp did give a warning for folks driving over that they did get caught with gusty winds. keep that in mind as well. back to you. thank you very much, mike. a south bay family is marking a painful anniversary this week. two years ago a hit-and-run driver plowed into a woman as she was trying to cross the street in san jose. the 17 year old was left with a

brok broken bones and traumatic brain injury. the hit-and-run was recorded but the driver managed to get away. her mother says although the driver that hit her daughter may never be caught, she has learned a lot from her daughter. >> we can't get him. he's probably never going to live a really great life. i've learned from my daughter that strength is incredible. the will to live, the love will keep you together. >> san jose police are still looking for that driver. 5:20. a tahoe area ski resort is making changes after the death of a 7 year old. john henderson fell 52 feet off a lift at sugar bowl in december of 2011. even though he was wearing a helmet, he died of head trauma. in response sugar bowl has adopted 13 new safety measures. there are now cameras monitoring lift loading stations.

skiers and snowboarders under 51 inches tall must ride with an adult. they added bull's eye targets to lift seats so riders know where to sit and there's a training chair lift at the base so beginners can practice before hopping on the real thing. >> it's hard to get on and off depending on how high up you are too. coming up, the new research that shows the statewide quake could actually happen.

berkeley school leaders looking at safety. consultants are looking at current safety procedures for a gunman on campus. it will work with police and fire departments to find ways to improve security. this is the second time in two years the district has hired

consultants. outside help was brought in following several incidents in 2011 at berkeley high school where some students were discovered with guns. in washington, vice president joseph biden continues his review of gun safety laws. he will meet with pro-gun advocates including the national rifle association. yesterday he met with victims groups and gun control advocates. the vice president is spearhe spearheading a task force assigned by president obama to look for ways to prevent gun violence. this could include stricter gun laws either through congress or by executive order. new evidence this morning suggests major earthquake could ripple through much of california if the faults were to rupture. it is separated in two segments northern and southern. scientists long believe the two were independent of one another but a new study suggests both sides could be affected by a certain type of earthquake meaning it could be felt from san diego to san francisco. it was this type of quake that

struck japan in 2011 and caused that major tsunami. even though forecasters did not think such a large quake could happen there. one thing we know for sure. today is a cold one out there. that's why meteorologist christina loren is out and about this morning. twin peaks in san francisco. kind of chilly up there, huh? >> just a little bit. just a little smidgen of cold up here. good morning to you. live up here from twin peaks because of a rare chance of low snow levels and potential for snow although it might be a slight chance it is there. 20% to 30% chance this morning. and i'm out here because i don't want to miss it. if it happens, it will be aweso awesome. look at what's happening. things are developing as we speak. just to the south at half moon bay now in the skyline boulevard area we are picking up that quick splash of pink. that's a mix of rain and snow coming down to potentially 2,700 feet. those levels are going to continue to fall as we head throughout the morning hours and

we're going to get to that forecast coming up in just a moment. first want to tell you about the state attorney general this morning wanting app makers to be more up front about what they know about you and how they share that information. business and tech reporter scott mcgrew joins us now with what it all means for us. >> good morning to you. more of a guideline. when you think about it when the attorney general of the nation's most populous state says i have a guideline, it's not a bad idea to treat it like law. cracking down on apps naming some developers in lawsuits over how much information apps can collect about you and why. this morning's guidelines, 22 pages of them out of sacramento, say among other things apps should warn you before sending out information. not just the first time you install them but every time so that you're reminded, hey, i'm about to publish your location when you hit go. an app privacy is a big thing. it's just around the corner. national laws that congress will

looking at the radar, look at what's developing right now. we're tracking a mix of rain and snow down to 2,600 feet and so we could see a dusting on skyline boulevard. that's what we're watching for as we progress through the next half hour. like i said before, temperatures will continue to drop and the showers albeit light and isolated, if they move over the higher elevations it could happen. we don't want to miss it which is why we're out here live this morning. you want your coat with you all day long. temperatures are only going to climb into the upper 40s and low 50s. make sure you have it handy all day. cold, cold, cold tomorrow through the weekend. we'll lose that chance for rain as of about 9:00 a.m. this morning. now, i certainly noticed a lot of people out there on the roadways this morning. it's a good warning to be advised of potential for black ice out there. >> definitely. with that potential also there will be more cars because it's so cold. folks who ride their bikes as an option might take the car and

maybe because of the heater option you don't have that on the bike. to fremont, southbound 880 picking up volume with headlights through the scales. we do have slowing coming out of altamont pass. i marked your commute direction for 580 and 680. you know what that is. commute direction same thing for castro valley. very slow jammed up to the scene of a car fire. no reports of injuries. it's blocking your slow lane out of castro valley and toward the castro valley y. a break in traffic there. a smoother drive toward the bay bridge toll plaza. east shore freeway and we'll get you one quick look at the toll plaza with no problem but chp says watch it. might be gusty winds. back to you. >> thank you very much. shark fans revvicar fans res

"today in the bay's" bob redell joins us live from the auto show this morning. bob, what are you sitting in this time? >> reporter: they're not going to let me drive this for good reason. steve is behind the wheel. he's a professional driver. trying to give us an idea of just the capabilities of this jeep grand cherokee. what did we just prove here? >> we went across ground clearance and the way we have this set up is about 9.4 inches. check out the stability of this rig. we're at 30 degrees here. >> reporter: if i lean this way, will i tip it over? >> do you want to rock it? >> reporter: i can see you putting your foot on the gas. the idea is consumers can come up here and get in the passenger seat with you and they're surprised by what? what do you hear most?

we have time to watch the movies. >> let's go. 5:47. it's cold out there this morning. we could see snow as low as 1,000 feet. meteorologist christina loren is live this morning twin peaks. could get a bit of dusting of the white stuff out there. >> that's right. good morning to you and marla and everyone at home. the chance is rare but it is there this morning, which is why we're out here live. it's a 20% to 30% chance. you wouldn't place any money on a 20% to 30% chance on a bet. however, if it happens, we don't want to miss it. when we talk about snow in the bay area, we get excited about 4,200 feet. snow on top of mt. hamilton. this morning we're seeing snow levels already dropping to 2,500 feet. take a look at this. we have two areas that we're watching very closely for you at this point. just to the south of half moon bay, skyline boulevard, yes. a mix of rain and snow now coming down to that level. the snow level itself where we

get straight snow is still above 2,700 feet. it's going to drop as we get colder and colder over the course of the next couple of hours. now, let's take you into santa cruz mountains where the same deal applies. what's interesting is the snow level is just below 2,000 feet. it's possible to get snow over 17 during the rush hour drive. mike will be on top of it for you. we'll get to his report in a minute. temperatures are chilly. in the 20s and 30s. the windchill making it feel even colder. make sure you put on your heavy coat. we're going to lose the chance for any shower activity by 9:00 today. highs will be cold. you'll need your jacket, your scarf and winter gear when temperatures fall this low in the bay area it's pretty much as cold as it gets around here. make sure you're prepared for that and get little ones ready to go. probably a good idea to protect their ears. it's very cold. seven-day forecast, we're still watching the king tide for the next couple days. 49 degrees inland today.

conducting a routine probation check of the home yesterday. they came face to face with mr. t. five-foot long cayman alligator. officers found him in a tank guarding 34 pounds of dried marijuana. the owner says it the gator is 16 years old. oakland zoo officials say he's very sick and the owner is in jail this morning. governor jerry brown is expected to lay out his state budget plan for the next year this morning. it's expected to be a little better than in previous years. the governor will ask for about $2 billion in cuts far less than the 25 billion from two years ago. extra tax revenue from prop 30 will help boost funding for public schools from $54 to $56 billion and and funds will go to higher education, 125 million each. still governor brown says the state must live within its means

and a helicopter. speaking of properties, new rules when it comes to mortgages. scott mcgrew says it's a rule that might prevent the average person from buying park place. >> not when you can only afford marvin gardens. the newly formed consumer financial protection bureau has issued new rules to banks to crack down on bad mortgages. two rules go into effect and they sound obvious in retrospect after we learned so much from the disaster five years ago. you see number one there. banks are going to have to make sure you can afford the monthly payments on the mortgage. no more than 43% of your monthly income. two, no more no document lending. banks actually need to see proof. now keep in mind the debates over the fiscal cliff not over, just delayed. it's not impossible that congress may scale back tax deductions on mortgage interest. in the past that was a sacred cow but no longer. many economists criticize the mortgage tax write-off as really a subsidy for the wealthy.

poor people tend to rent. they don't get the break. it hurts poor in other way. if homeowners get a break, they can pay more for the home. the subsidy pushes home prices higher. now these days not a real big break because homeowners are not paying that much in interest. down to 2.5% in some cases. one possibility would be the congress would say there's going to be a limit to how much your house could be worth and still qualify for the tax break. you know where i'm going with this. let's say it's a half million dollars. that limits us in the bay area unfairly. our half million dollar houses not to gripe too much are just houses. >> they are fixer uppers. >> we would get hit as people living in mansions when they are fixer uppers. >> take your castle and we'll see you later. testing begins later today on the new bay lights project on the bay bridge. this is a live look at the bay
